Buy in your own name or through a company—what to consider

Legović Accounting

This is the question clients ask us almost every time, and there is no single correct answer. It depends on what you intend to do with the property, how long you intend to hold it, and where you are tax resident.

Buying in your own name

Simpler and cheaper to set up. No company formation, no annual financial statements, no bookkeeping cost for the company itself. For a property used mainly privately and rented out occasionally, this is usually the sensible choice.

The limits appear once the scale of renting grows, when you plan to invest in several properties, or when you want to separate personal assets from business risk.

Buying through a company

A company makes sense when the property is primarily a business asset. Costs of investment, maintenance and furnishing are then visible in the company books, and VAT registration can change the arithmetic on larger works.

The price is administration. The company has to be formed, its books kept, statements filed, and one day closed if it is no longer needed. That cost is there every year, whether or not the property earned anything.

What is most often overlooked

  • Your tax position at home. Income earned in Croatia is generally also declared in the country where you are tax resident. Double taxation treaties ensure you do not pay twice, but they do not remove the obligation to declare.
  • The exit. Selling the property and selling shares in a company that holds the property are not the same thing — neither in procedure nor in tax treatment.
  • Inheritance. Transferring the property and transferring company shares to heirs work differently, especially when the heirs live in another country.

Before you decide, it is worth working through both scenarios on paper with your actual figures. That is an hour-long conversation that often changes the decision.
